Finally! Real Housewives Of Atlanta Star Kandi Burruss Is Suing Kim Zolciak Over “Tardy for the Party”

Kandi Burress may have been a little tardy when filing this lawsuit.

After what some may consider a four-year delay, The Real Housewives of Atlanta star is suing her former castmate Kim Zolciak in Federal Court claiming copyright infringement and that she never received royalties from the sale of her 2009 hit track “Tardy for the Party.” Burrus, who co-wrote the song, is joined in the suit by fellow writer Rodney Richard.

“I hardly got anything from ‘Tardy for the Party,’” Burruss wrote in a blog back in October of 2010. “That is the truth. I am not mad about it. I really blame myself because I didn’t handle my business correctly.”

According to the lawsuit filed this week in the U.S. District Court in Georgia, nearly 102,00 copies of “Tardy for the Party” were sold and Burruss never saw one penny, except for a $4,000 production fee. Filed by fellow The Real Housewives of Atlanta star Phaedra Parks, who will serve as Burruss’ legal council, the lawsuit also claims that “Tardy For The Party” was unlawfully licensed, distributed, and sold.

“Kandi tried to pull the song down in Dec on iTunes,” Zolciak tweeted in her defense, “but after I showed documents and proved points song was immediately put back up.”

Burruss also wants to stop Zolciak from making any more money from the track until the case is settled, which would require the “destruction of all copies of the infringing single and any other product of defendant’s that infringe plaintiffs’ copyrights.” But Zolciak, who stars on her own Bravo reality series Don’t Be Tardy for the Party, doesn’t seem worried.

“This is nothing short of a publicity stunt,” she told TooFab. “I find this lawsuit funny yet sad. Coming after me now and this song is 4 years old? I have in fact overpaid Kandi and have documents to prove it, and my legal team will handle this accordingly.”
